SHRR 46-040. Review of Disputed Dismissals (1) The Committee Chair or his or her designee will review disputed dismissals issued by the Office pursuant to SHRR 40-305. (2) In order to challenge a dismissal the Charging Party must file a written statement challenging the dismissal with the Commission within 30 days after the Office sent its notice dismissing the case. Civil Rule 6 "Time" applies to this rule. The Charging Party's statement shall state specifically why the Office was in error in dismissing the case. (3) The Chair will review the disputed dismissal within five days of when the Charging Party's challenge is received, except in extraordinary circumstances. (4) The Chair's review will consist of evaluating the Office's reasons for dismissal and the Charging Party's reasons for challenging the Office's decision to dismiss along with such further action as the Commission may deem to be necessary. |
